  1. About this policy

Advanced Mental Performance, operated by Nathan Laverty (“AMP”, “we”, “us” or “our”), provides the Advanced Mental Performance mobile application and associated coaching services.

This Privacy Policy explains how we collect, hold, use, disclose and protect personal information in connection with the AMP app and AMP coaching programmes.

By using the AMP app, you acknowledge the practices described in this Privacy Policy.

  1. Information we collect

The information we collect depends on how you use AMP and how your participation in an AMP programme has been arranged.

Participant and enrolment information

Before you access the app, AMP may create a participant record containing information such as:

• Your name
• Your email address
• Your team or organisation, where applicable
• Your programme start date
• Your service level
• Your programme and content access settings

This information may be provided directly by you, entered by an AMP coach or administrator during enrolment, or provided by an organisation arranging your participation with appropriate authority.

The mobile app does not necessarily ask you to enter this information again. It may use information already associated with your access code to create and display your participant profile.

Access and account information

When you access the AMP app, we may collect or generate:

• Your onboarding or access code
• An internal account or participant identifier
• Authentication and session information
• Records showing when an access code was activated or used
• Your programme enrolment and access status

Programme activity and responses

When you use the app, we may collect:

• Exercise and training completion records
• Programme progress
• Audit responses
• Self-reported outcomes and feedback
• Answers provided during AMP exercises
• Whether you achieved a selected outcome
• Interactions with programme content
• Audio or video progress where recorded by the app

Messages and support information

If you communicate with an AMP coach through the app, we collect the messages and information you choose to submit.

Information included in messages may sometimes reveal personal or sensitive information. Please avoid submitting medical records or highly sensitive information unless it is relevant and you are comfortable providing it.

Technical information

We and our service providers may automatically process technical information needed to operate, protect and troubleshoot the app, including:

• Device operating system
• App version
• Push notification token, if notifications are enabled
• Authentication and server logs
• IP address
• Crash or diagnostic information
• Dates and times the app or its services are accessed

We do not use this information for third-party advertising or cross-app tracking.

  1. Information we do not intentionally collect

The AMP app does not intentionally collect:

• Precise location
• Contacts
• Photos or videos from your device
• Microphone recordings
• Payment card information
• Data for third-party advertising
• Data for sale to data brokers

AMP is a mental performance and coaching service. The app is not intended to diagnose or treat medical conditions.

We may collect information:

• Directly through your use of the AMP app
• Through messages, responses and feedback you submit
• From an AMP coach or administrator during enrolment
• From an organisation arranging your participation, where appropriate
• Automatically through the app, our servers and service providers
• When you contact AMP for support

We use personal information to:

• Verify access codes and authenticate participants
• Create and manage participant accounts
• Deliver AMP coaching programmes and training content
• Provide personalised programme access
• Record progress and exercise completion
• Allow participants to communicate with their coach
• Provide coaching support and respond to enquiries
• Send service and programme notifications
• Maintain the security and reliability of the app
• Investigate technical problems
• Improve the functionality and participant experience
• Manage AMP’s legal, administrative and record-keeping obligations

We do not use personal information for third-party advertising or sell personal information.

  1. Push notifications

With your permission, AMP may send push notifications relating to your programme, exercises, coach messages, reminders or account.

You can disable push notifications at any time through your device settings. Disabling notifications will not prevent you from accessing the rest of the app.

  1. Disclosure of information

We may disclose personal information to:

AMP personnel

Authorised AMP coaches, administrators and support personnel may access information where reasonably necessary to deliver your programme and support your account.

Technology and service providers

We use third-party service providers to support functions such as:

• Database hosting
• Authentication
• Cloud infrastructure
• App development and distribution
• Push notifications
• Email delivery
• Security and troubleshooting

These providers may include Supabase, Expo and Apple.

We require service providers to handle personal information only for authorised service purposes and to apply privacy and security protections appropriate to the information they process.

Team or organisation programmes

Where participation is arranged by an employer, team or other organisation, AMP may provide aggregated or de-identified programme information to that organisation.

AMP will not ordinarily provide your private coach messages, individual exercise responses or identifiable programme data to a sponsoring organisation unless:

• You have been informed and consented
• It is reasonably necessary to provide the service you requested
• Disclosure is required or authorised by law

Legal and safety purposes

We may disclose information where reasonably necessary to:

• Comply with applicable law, a court order or lawful government request
• Protect the rights, safety or security of AMP, participants or others
• Investigate suspected fraud, misuse or security incidents
• Establish, exercise or defend legal claims

  1. Overseas processing

Some of our service providers may store or process information outside Australia, including in the United States and other countries in which those providers operate.

Privacy laws in those countries may differ from Australian law. We take reasonable steps to use reputable service providers and protect personal information when it is processed overseas.

  1. Data security

We use reasonable technical and organisational measures designed to protect personal information, including access controls, authentication controls and encrypted network connections.

Access to participant information is limited to authorised people and service providers who require it for legitimate operational purposes.

No electronic system is completely secure. We cannot guarantee that unauthorised access, loss or misuse will never occur.

  1. Data retention

We retain personal information while:

• Your AMP programme or account is active
• The information is required to deliver coaching or support
• It is reasonably required for security, legal, administrative or record-keeping purposes
• A dispute or complaint remains unresolved

When personal information is no longer reasonably required, we will take reasonable steps to delete or de-identify it.

Information may remain temporarily in secure backups after deletion from active systems. Backup information will not ordinarily be accessed except for security, disaster recovery or legal purposes.

You may request deletion of your AMP account and associated personal information by contacting:

Please include enough information for us to identify and verify your account. We may ask for additional information before completing the request to protect your account from unauthorised deletion.

We will generally action verified deletion requests within 30 days.

We may retain limited information where required by law or reasonably necessary for fraud prevention, security, dispute resolution or legal record-keeping. Where information must be retained, it will no longer be used for ordinary programme purposes.

Deleting your account may permanently remove your access to AMP programme content, messages and progress records.

  1. Accessing or correcting your information

You may ask to:

• Access personal information AMP holds about you
• Correct information that is inaccurate, incomplete, out of date or misleading
• Receive information about how your data has been used
• Withdraw consent where processing is based on consent

You may:

• Disable push notifications in your device settings
• Choose what information you include in coach messages
• Request access to or correction of your information
• Request deletion of your account and information
• Stop using the app

Some information is necessary to provide core AMP functions. If you do not provide or allow AMP to process that information, we may be unable to provide access to the programme.

  1. Tracking and advertising

AMP does not:

• Display third-party advertising
• Sell personal information
• Share personal information with data brokers
• Track users across unrelated apps or websites for advertising purposes

We may update this Privacy Policy when our app, services, technology or legal obligations change.

The current version will be published on the AMP website with the date it was last updated. Material changes may also be communicated through the app or by email where appropriate.
